Q: I’ve been reading the Brilliance in Commerce eBook, and I have couple of more questions. If my mom is heavily invested in the stock market at the time of her passing, and prior to setting up a Natural Law Trust, could I set up a Natural Law Trust within a couple of days of her passing and still avoid probate, death taxes, inheritance tax, and capital gains taxes if I were to get an NLT in place within a week after her passing?

There are various types of trusts out there that can avoid probate, but our NLT is the best in the world for many reasons. One of them is that it not only shields estates from probate, but also its right to operate is not subject to the authority of courts, attorneys, or the government in general. It is truly sovereign. And it has a 100% success rate going back five or more decades.

A will cannot give you or your mom these benefits. Neither can any other type of estate planning entity.

Your very best approach to this, and perhaps the only one that could succeed, is to win your mother’s heart and educate her to sign you on as either her successor trustee (that would be best) or at least a beneficiary.

Some of us who work with BIC and many of our clients have been successor trustees for the trusts of mothers or fathers who passed away, and the experience was seamless. The successor could walk into the bank sometime soon after the passing, and show two documents – – the death certificate and the notarized successor trustee minute. The banks have signed that successor trustee on as account signatory the very same day.

No death taxes, no attorney fees, no court costs, no probate, no capital gains taxes, and no depletion of the estate whatsoever. If your mom clearly understands this and if she loves you, this is obviously what she would most want to do. She can gain this understanding simply by reading the trust section of our website, watching the videos, and reading the eBook.

No one, including your mom, would need to sell their stocks in order to transfer title of ownership of them into the trust. There is a simple form that our trust writer can provide her to transfer this ownership.

She should understand that she is invited to be her own first trustee, so she will still have control of the assets after they are transferred to the trust. This follows the motto of the super-rich, who have said “own nothing; control everything”. Ownership comes with liabilities. But those who transfer ownership into an entity like our NLT which the trust creator controls, maintains the trust client’s control if she becomes the first trustee.

If she wishes to withdraw a stream of cash income or assets from the trust for her own living expenses or things she wishes to purchase for any noble purpose, she can do so, authorized by the Housing Resolution Minute and the Spiritual Resolution Minute, which come with the trust. So just because she has given up ownership doesn’t mean she has given up control.

Hence even while she is still alive, she will benefit, because the assets she transfers into the trust will no longer be subject to any kind of tax reporting or tax paying, and would not be accessible by creditors to satisfy any potential liabilities against her personal name. That’s called “bullet proof asset protection”.

Thus the trust would begin benefitting her immediately upon its setup and transfer title of ownership of assets into it, helping her both here and in the hereafter. In the hereafter, it would be benefitting her heirs by placing them – – meaning at least presumably you – – in control of the trust and its assets via the status of successor trustee.

If she has other heirs besides yourself, she could make them beneficiaries, and you as successor trustee would then become responsible for distributions to them according to your mom’s wishes and according to your best discretion. And there are many other benefits of operating an NLT that are reviewed in the eBook and the videos.

If she is ill or bedridden and doesn’t have the attention span to absorb that much information easily, then hopefully you could sit next to her and read it to her in small bite-size chunks – – a little at a time until she is up to speed about it.

A teacher once brought balloons to school and asked his students to blow them up and write their name on the balloon. After the children threw their balloons into the hall, the teacher walked around the hall and mixed them all up.

The children were given five minutes to find the balloon with their own name on it, but although they searched frantically, hardly anyone found their own balloon.

The teacher then asked them to take the balloon nearest to them and give it to the child whose name was on it. In less than two minutes, everyone had their own balloon in their hands.

The teacher told the children, “These balloons are like happiness. We won’t find it if we only look for our own happiness. But if we care about someone else’s happiness, it will ultimately help us find our own.”
